The Motion and concomitantly filed papers have not addressed the controversial ‘Don’t Ask, Don’t Tell’ policy itself, and have not sided with either of the parties in the case - the Log Cabin Republicans, or the US Department of Justice. Instead, the Motion has limited itself to arguments regarding the validity, or lack thereof, of the uncertified October 2010 Judgment, from which the appeals were taken.
